    THE INDUSTRIAL TRIBUNALS

    DECISION

    The decision of the tribunal is that:-

     

    (i)         The title of the respondent is ordered to be amended from Sodexo Northern Ireland to that set out above, namely Sodexo Limited.

     

    (ii)        The claimant’s claims of failure to consult and/or breach of the Transfer of Undertakings (Protection of Employment) Regulations 2006, as amended, are dismissed, following oral withdrawal by the claimant’s representative at the hearing of this matter on 29 July 2014.

     

    (iii)       The tribunal makes a declaration that the respondent has made an unauthorised deduction from the wages of the claimant in the sum of £368.60; and the tribunal orders the respondent to pay to the claimant the sum of £368.60.

    The claimant was represented by Ms M Gavin, Solicitor, of Francis Hanna & Company, Solicitors.

    The respondent did not appear and was not represented having not presented a response to the tribunal.


     

    Reasons

     

    1.         Reasons were given by me orally at the conclusion of the hearing, pursuant to Rule 30(2) of the Industrial Tribunals Rules of Procedure 2005, contained in Schedule 1 of the Industrial Tribunals (Constitution and Rules of Procedure) Regulations (Northern Ireland) 2005.

     

    2.         This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
