AID TO INDUSTRY (AMENDMENT) ACT (NORTHERN IRELAND) 1964 AID TO INDUSTRY (AMENDMENT) ACT (NORTHERN IRELAND) 1964 - LONG TITLE An Act to extend and amend the Aid to Industry Act (Northern Ireland) 1961, and for purposes connected therewith. [18th February 1964] Ss.13 amend ss.13 of 1961 c.17 (NI) AID TO INDUSTRY (AMENDMENT) ACT (NORTHERN IRELAND) 1964 - SECT 4 Increase in aggregate amount of contributions. 4. Subs.(1) amends s.6 of 1961 c.17 (NI) (2) There shall be defrayed out of moneys provided by Parliament any increase attributable to any provision of this Act in the sums which may be so defrayed under section 6 of the principal Act. S.5 amends s.7 of 1961 c.17 (NI) AID TO INDUSTRY (AMENDMENT) ACT (NORTHERN IRELAND) 1964 - SECT 6 Powers of entry and inspection. 6.(1) For the purpose of ascertaining or verifying any matter arising in connection with the execution of the principal Act or of any order made thereunder or of this Act, any person authorised by the Ministry in that behalf may, at all reasonable times and on producing, if so required, a duly authenticated document showing his authority, (a)enter and inspect the premises, plant and machinery of a registered person or person seeking to be registered; (b)require any person in those premises who is for the time being in charge thereof or in control of the work carried on therein to produce to the person making the inspection, and to allow him to examine, such books of account, records and other documents and to furnish such other information as he may reasonably require for the aforesaid purpose; (c)take copies of and extracts from such books, records and other documents as are referred to in paragraph (b). (2) Any person who (a)wilfully obstructs any person exercising a right conferred by subsection (1); or (b)refuses to produce any books, records or other documents or to furnish any other information which he is required to produce or furnish under sub-section (1); (3) Any information which is obtained under the powers conferred by subsection (1) shall not, without the previous consent in writing of the person carrying on the undertaking to which the information relates, be disclosed except in connection with the execution of the principal Act or of any order made thereunder or of this Act or for the purposes of any proceedings pursuant thereto or any report of such proceedings. (4) Any person contravening the provisions of subsection (3) shall be guilty of an offence and shall be liable (a)on summary conviction, to imprisonment for a term not exceeding three months or to a fine not exceeding fifty pounds, or to both such imprisonment and such fine; or (b)on conviction on indictment, to imprisonment for a term not exceeding two years or to a fine not exceeding one hundred pounds, or to both such imprisonment and such fine. AID TO INDUSTRY (AMENDMENT) ACT (NORTHERN IRELAND) 1964 - SECT 7 Time for bringing summary proceedings. 7.(1) Notwithstanding any provision in any enactment prescribing the period within which summary proceedings may be commenced, summary proceedings for an offence under the principal Act or this Act may be commenced at any time within the period of six months from the date on which evidence, sufficient in the opinion of the Ministry to justify a prosecution for the offence, comes to the knowledge of the Ministry, or within the period of twelve months after the commission of the offence, whichever period last expires. (2) For the purposes of subsection (1) a certificate, purporting to be signed by the Minister or a secretary or assistant secretary of the Ministry as to the date on which such evidence as aforesaid came to the knowledge of the Ministry, shall be conclusive evidence thereof. AID TO INDUSTRY (AMENDMENT) ACT (NORTHERN IRELAND) 1964 - SECT 8 Interpretation. 8. In this Act "the principal Act" has the meaning assigned to it in section 1 and "Minister" and "Ministry" have the same meanings as in the principal Act. AID TO INDUSTRY (AMENDMENT) ACT (NORTHERN IRELAND) 1964 - SECT 9 Short title, construction and citation. 9.(1) This Act may be cited as the Aid to Industry (Amendment) Act (Northern Ireland) 1964. (2) This Act shall be construed as one with the principal Act and that Act and this Act may be cited together as the Aid to Industry Acts (Northern Ireland) 1961 and 1964.
