Effect of insanity etc., on criminal liability. 3.(1) Subject to section 6, if a person charged with the commission of an offence is found to have been, at the time the offence is alleged to have been committed, an insane person within the meaning of this Act, he shall not be convicted of that offence. Subs.(2) amends s.56 of 1961 c.15 (NI) (3) In section 56(2) of the Act of 1961 ... references to an insane person shall be construed as references to any person who is an insane person within the meaning of this Act; and references to "insane" and "insanity" shall be construed accordingly; ... residue repeals in pt. s.56(2)(b) of 1961 c.15 (NI) (4) This section shall have effect in place of any rule of the common law inconsistent with this section. (5) Nothing in this section shall prejudice any powers exercisable by any court under sections 48 to 55 of the Act of 1961 or by a magistrates, court under section 58 of the Magistrates' Courts Act (Northern Ireland) 1964.
