CRIMINAL PROCEDURE ACT 1851 CRIMINAL PROCEDURE ACT 1851 - LONG TITLE An Act for further improving the Administration of Criminal Justice.{1} [7th August 1851] Preamble rep. by SLR 1892 Ss.117 rep. by 1861 c.95 s.1 sch.; SLR 1875; SLR 1892; 1916 c.50 s.48(1) sch.; 1945 c.16 (NI) s.9(3) sch.2; 1967 c.18 (NI) s.15(2) sch.2 Pt.II CRIMINAL PROCEDURE ACT 1851 - SECT 18 Coin and bank notes may be described in indictments simply as money. 18. In every indictment in which it shall be necessary to make any averment as to any money or any note of the Bank of England or any other bank it shall be sufficient to describe such money or bank note simply as money, without specifying any particular coin or bank note; and such allegation, so far as regards the description of the property, shall be sustained by proof of any amount of coin or of any bank note, although the particular species of coin of which such amount was composed, or the particular nature of the bank note, shall not be proved,.... In any plea of autrefois convict or autrefois acquit it shall be sufficient for any defendant to state that he has been lawfully convicted or acquitted (as the case may be) of the said offence charged in the indictment. S.29 rep. by 1861 c.95 s.1 sch.; SLR 1950 CRIMINAL PROCEDURE ACT 1851 - SECT 30 Interpretation. 30. In the construction of this Act the word "indictment" shall be understood to include... "presentment," as well as indictment, and also any "plea," "replication," or other pleading, and any nisi prius record;... and the word "property" shall be understood to include goods, chattels, money, valuable securities, and every other matter or thing, whether real or personal, upon or with respect to which any offence may be committed.
