DEVELOPMENT OF TOURIST TRAFFIC (AMENDMENT) ACT (NORTHERN IRELAND) 1963
- LONG TITLE

An Act to amend the Development of Tourist Traffic Acts (Northern
Ireland) 1948 and 1952; to empower the Ministry of Commerce to make
grants in respect of the improvement or the provision of certain
hotels, guest houses and boarding houses; and for purposes connected
with those matters.
[29th January 1963]

Board.

DEVELOPMENT OF TOURIST TRAFFIC (AMENDMENT) ACT (NORTHERN IRELAND) 1963
- SECT 1

1.(1) The maximum membership of the Northern Ireland Tourist Board
(in this Act referred to as "the Board") shall be increased from
ten to fourteen, and accordingly .... residue amends s.1 of 1948
c.4 (NI)

Grants for works to, or for construction of, certain hotels, guest
houses and boarding houses.

- SECT 6

6.(1) Subject to the following provisions of this Act, the Ministry
of Commerce (in this Act referred to as "the Ministry") may make
to any person making an application in that behalf a grant in
respect of

(a)the execution, in or to any premises to which this section
applies, of works of such a description as may be prescribed;

(b)the construction of any building for use as an hotel, a guest
house or a boarding house if the Ministry is satisfied that the
building will, when completed, be one to which this section applies.

This section applies to the following premises and buildings, that
is to say

(a)any hotel entered in the register of hotels maintained under
section 10 of the principal Act;

(b)any guest house entered in the register of guest houses
maintained under that section;

(c)any boarding house entered in the register of boarding houses and
apartment houses maintained under that section; and

(d)any premises which the Ministry is satisfied will, after the
execution of the works, qualify for registration in any of those
registers;

- SECT 7

7.(1) The Ministry shall not make a grant under section 6

(a)unless an advisory committe, appointed by the Minister of Commerce
to advise the Ministry on matters relating to the making of grants
under that section, recommend that the Ministry should make the
grant; or

(b)where the total cost (as determined by the Ministry) of the
works in respect of which an application for a grant is made is
less than the prescribed amount; or

(c)in respect of any works commenced before [4th October, 1966]; or

(d)in pursuance of an application for a grant received by the
Ministry [after 4th October [1971]].

(2) The amount of any grant under section 6 shall not exceed
[one-third] of the cost (as determined by the Ministry) of the
works in respect of which it is made.

(3) The payment of any grant or of any instalment of a grant
pursuant to section 6 shall be subject to such conditions (including
conditions requiring the repayment of grants) as the Ministry, after
considering the advice of the advisory committee appointed under this
section, may determine.

(4) Without prejudice to sub-section (3), where the Ministry pays
any sum by way of grant under section 6 in respect of the
execution of any works, the person who receives it or, if he dies,
his personal representatives, shall repay that sum (or such lesser
sum as the Ministry, after considering all the circumstances, may
determine) to the Ministry if the relevant premises cease to be
used as an hotel, a guest house or a boarding house, as the case
may be, before the expiration of three years beginning with the
date of the completion of the works in respect of which the grant
is made.

(5) Nothing in sub-section (4) shall affect the power of the
Ministry to make a grant under section 6 subject to a condition
corresponding to the provisions of that sub-section except for the
substitution of a period longer than three years for the period of
three years mentioned in that sub-section.

(6) Any sum which must be repaid to the Ministry by virtue of any
condition imposed pursuant to sub-section (3), or under sub-section
(4), may be recovered by the Ministry as a civil debt.

(7) In this section "relevant premises" means

(a)where the works (including works of extension) in respect of
which a grant is made under section 6 consist of works in or to
existing buildings, those buildings;

(b)where the works in respect of which a grant is made under
section 6 consist of the construction of new buildings (not being
buildings to be used in conjunction with existing buildings) those
new buildings.

- SECT 8
Supplemental provisions as to advisory committee on grants.

8.(1) In the exercise of their functions under section 7 the
advisory committee shall act in accordance with general directions
given to them by the Ministry with the approval of the Ministry of
Finance.

(2) The Ministry may, out of moneys provided by Parliament, pay to
members of the advisory committee appointed under section 7 such
travelling, subsistence and other allowances as the Ministry may,
with the approval of the Ministry of Finance, determine.

- SECT 9
Regulations.

9.(1) The Ministry may make regulations prescribing

(a)anything which is to be prescribed for the purposes of this Act;

(b)the aggregate of the grants which may be made under section 6
in respect of the same premises or buildings in pursuance of
applications for such grants received by the Ministry [during

(i)the period of three years beginning with the passing of this
Act; or

(ii)the period of two years beginning with 4th October, 1966; [or

<(iii)the period of three years beginning with 4th October 1968; or during all those periods combined.]]

(2) Regulations made by the Ministry under this Act shall be
subject to affirmative resolution.

Financial provisions.

(2) The aggregate of the grants made by the Ministry under section
6 shall not exceed [six million five hundred thousand pounds].

Interpretation.

12. In this Act

"the Ministry" has the meaning assigned by section 6(1);

"the principal Act" has the meaning assigned by section 1(1);

13. This Act may be cited as the Development of Tourist Traffic
(Amendment) Act (Northern Ireland) 1963 and the Development of
Tourist Traffic Acts (Northern Ireland) 1948 and 1952 and this Act
may be cited together as the Development of Tourist Traffic Acts
(Northern Ireland) 1948 to 1963.
