MAGEE UNIVERSITY COLLEGE LONDONDERRY ACT (NORTHERN IRELAND) 1970 -
LONG TITLE

An Act to provide for the transfer of certain property from the
Trustees of Magee University College Londonderry to the New
University of Ulster, and for the amount payable in respect of that
transfer; to enable those Trustees to deal with the contents of the
buildings so transferred; to set out the duties of those Trustees,
and to confer jurisdiction on the High Court to deal with certain
property; to authorise the making of regulations for compensation, in
certain circumstances, for members of the academic staff and other
employees of that College; to give that University the option to
purchase the premises of the Magee Theological College Londonderry;
to authorise those Trustees to convey the Peace Thanksgiving Hostel,
and to transfer the Peace Thanksgiving Fund, to the Trustees of the
Presbyterian Church in Ireland; and for purposes connected therewith.

Transfer of certain property from Trustees to University.

MAGEE UNIVERSITY COLLEGE LONDONDERRY ACT (NORTHERN IRELAND) 1970 -
SECT 1

1.(1) If Her Majesty in Council is pleased to provide by royal
charter for the foundation of the New University of Ulster, then on
such day (in this Act referred to as "the appointed day") as the
Minister of Education may, with the consent of the Trustees of
Magee University College Londonderry (in this Act referred to as
"the Trustees") and of the Council of the New University of Ulster
(in this Act referred to as "the University"), by order appoint,
the property of the Trustees set out in Part I of Schedule 1
shall by virtue of this subsection be transferred to the University.

(2) The property transferred to the University by virtue of
subsection (1) shall be held by the University, in accordance with
the charter, for the purpose of maintaining in Londonderry, as an
integral part of the University, an institution to be known as
Magee University College, ...

Duties of Trustees.

(2) The Trustees shall

(b)continue to pay any pension payable by the Trustees immediately
before the appointed day, and may pay any increase in such pension,
or any gratuity, which would have been payable but for the passing
of this Act;

SECT 6
Compensation for staff.

6.(1) The Ministry of Education, with the approval of the Ministry
of Finance, may after the appointed day by regulations make
provision for the payment, on such terms and subject to such
conditions as may be specified in the regulations, of compensation
to any member of the academic staff, or any other employee, of the
College who

(a)suffers loss or diminution of emoluments, or whose terms or
conditions of service are adversely affected, by reason of his
becoming employed by the University; or

(b)suffers loss of employment by reason of his not being employed
by the University.

(2) Regulations made under this section may include provision as to

(a)the manner in which, the time within which and the person to
whom, any claim for compensation is to be made; and

(b)the determination of questions arising under the regulations.

(3) The Ministry of Education shall pay, out of moneys provided by
Parliament, any compensation payable under this section.

(4) Regulations under this section shall be subject to affirmative
resolution.

Peace Thanksgiving Hostel and Fund.

8. The Trustees shall, on request being so made by the General
Assembly

(a)convey the premises situate at 5 and 6 Crawford Square in the
City of Londonderry and known as the Peace Thanksgiving Hostel; and

(b)transfer the unexpended residue of the funds and investments known
as the Peace Thanksgiving Fund;

Exemption from stamp duty.

SECT 9

9.(1) Section 12 of the Finance Act 1895 shall not operate to
require the delivery to the Ministry of Finance of a copy of this
Act or the payment of stamp duty under that section on any copy
of this Act.

(2) Section 9 of the Finance Act (Northern Ireland) 1936 shall not
apply to the transfer of property authorised by section 1.

SECT 10
Interpretation.

10. In this Act

"the Act of 1953" has the meaning assigned by section 3(2)(b);

"the appointed day" has the meaning assigned by section 1(1);

"the College" has the meaning assigned by section 3(2);

"the General Assembly" means the body known as "The General Assembly
of the Presbyterian Church in Ireland", or other the supreme
authority for the time being of the Presbyterian Church in Ireland,
constituted in accordance with the laws of that Church, and any
authority duly empowered to represent or act for the General
Assembly in that behalf;

"the Trustees" has the meaning assigned by section 1(1);

"the University" has the meaning assigned by section 1(1).

SECT 11
Repeals.

11.Subs.(1), with Schedule 3, effects repeals

(2) The repeal of section 10 of the Act of 1953 shall not affect
any trustee appointed under that section before the appointed day.

Short title.

12. This Act may be cited as the Magee University College
Londonderry Act (Northern Ireland) 1970.
