PUBLIC HEALTH AND LOCAL GOVERNMENT (MISCELLANEOUS PROVISIONS) ACT
(NORTHERN IRELAND) 1955 - LONG TITLE

An Act to extend the powers of certain public authorities to supply
water, to increase the amount recoverable by local authorities in
respect of expenses of providing water supplies, and to provide for
the incidence of certain water rates; to restrict the use of public
sewers for private purposes; to regulate the provision of sanitary
conveniences at certain sports grounds; to provide for the variation
of stallages, rents and tolls for markets and slaughter-houses, and
to declare the law touching the extent of certain slaughter-house
charges; to extend thr powers of certain local authorities with
respect to war memorials; to enable the honorary freedom of certain
boroughs to be conferred on persons other than individuals; to
increase the sums which rural district councils may subscribe to
their association; to empower certain local authorities to contribute
towards the maintenance or establishment of certain museums; to
empower urban sanitary authorities to adopt private streets; to
empower certain local authorities to acquire or provide, and to
furnish, accommodation for certain public purposes, and to acquire
land for the purpose of such provision; to provide for the annual
audit of the accounts of certain local authorities; to extend the
term for the repayment of sums temporarily borrowed by local
authorities; to make further provision with respect to the sealing
of contracts by local authorities; to impose penalties on members of
certain local authorities who participate in matters while pecuniarily
interested; to provide for the variation of the rate of interest
payable on certain compensation moneys; to empower certain local
authorities to pay travelling and subsistence allowances to their
members and to insure their members against accidents; to declare
the powers of county councils with respect to the collection of
rates in one sum; to empower certain local authorities to establish
certain special funds; to provide for the dissolution and transfer
of functions of town commissioners; to facilitate the payment of
local government superannuation benefits in certain special
circumstances, and make further provision as to the superannuation of
certain officers of joint bodies; and for purposes connected with
the matters aforesaid.

Expenses of provision of water supply recoverable by district
councils.

2. The amount of expenses which a [district council] may recover in
respect of the provision by them of a supply of water under
section five of the Water Supplies and Sewerage Act (Northern
Ireland), 1945, shall be increased to fifty pounds, but such
expenses shall be recoverable in respect only of certain things
provided and done for the purposes of that section, and accordingly
... residue, with Schedule, substitutes proviso to s.5(5) of 1945
c.17 (NI)

Provision of sanitary conveniences, etc., at sports grounds, inns and
other places of refreshment or entertainment.

4. The owner or occupier of any sports ground, or any inn,
public-house, beer-house, eating-house, refreshment-house or place of
public entertainment anywhere in Northern Ireland shall, if so
required by notice in writing by the [district council], provide and
maintain thereon

(a)in the case of a sports ground, such sanitary conveniences;

(b)in the case of any other such house or place as aforesaid, such
urinals;

Variation of certain stallages, rents and tolls.

5.(1) A [district council] empowered by any enactment (whether public
general or local)

(a)to establish and regulate markets; or

(b)to provide and regulate slaughter-houses; and

(c)to take stallages, rents or tolls in respect of the use of
markets or slaughter-houses;

(i)vary the amount of any such stallages or rents;

(ii)vary the kinds, descriptions, quantities or numbers of commodities
or animals in respect of which such tolls may be taken;

<(iii)with the approval of the Ministry fix the tolls to be taken in respect of such markets or slaughter-houses;

Inclusion in slaughter-house tolls of charges for services.

6. It is hereby declared that a power conferred in whatsoever words
by any enactment (whether public general or local) on any [district
council] to take tolls or make charges in respect of the use of a
slaughter-house includes and always has included power to make
charges in respect of any services provided by the [council] at
that slaughter-house, and accordingly ... residue, with Schedule,
inserts s.105B in 1878 c.52

Powers of district councils as respects war memorials.

8. The powers conferred on [district councils] by section seven of
the Act of 1923 with respect to war memorials shall be extended,
and accordingly ... residue, with Schedule, substitutes s.7(1)(2)(b)

26. In this Act

"Act of 1878" means the Public Health (Ireland) Act, 1878;

27.(1) This Act may be cited as the Public Health and Local
Government (Miscellaneous Provisions) Act (Northern Ireland), 1955.

twenty-seven and the Schedule as relates to those sections, and t
Supplies and Sewerage Acts (Northern Ireland), 1945 and 1949, may be
cited together as the Water and Sewerage Acts (Northern Ireland),
1945 to 1955.
