SUPPLEMENTARY BENEFITS &C. ACT (NORTHERN IRELAND) 1966 SUPPLEMENTARY BENEFITS &C. ACT (NORTHERN IRELAND) 1966 - LONG TITLE An Act to provide for the dissolution of the National Assistance Board for Northern Ireland and for the transfer of their functions to the Ministry of Health and Social Services and a Supplementary Benefits Commission for Northern Ireland established under this Act; to replace the National Assistance Act (Northern Ireland) 1948 by provisions giving rights to non-contributory benefit; to enact further provisions relating to the said Ministry; and for purposes connected with those matters. [9th August 1966] The Act was repealed by 1977 NI 27 art.42(3) sch.7 Pt.I. Section 26 (printed below) was revived with retrospective effect by 1980 NI 8 art.15(3) SUPPLEMENTARY BENEFITS &C. ACT (NORTHERN IRELAND) 1966 - SECT 26 Recovery in cases of misrepresentation or non-disclosure. 26.(1) If, whether fraudulently or otherwise, any person misrepresents or fails to disclose any material fact, and in consequence of the misrepresentation or failure (a)the Ministry incurs any expenditure under this Act, or (b)any sum recoverable under this Act by or on behalf of the Ministry is not recovered, (2) If, whether in connection with any legal proceedings or otherwise, any question arises whether any or what amount paid by way of benefit is recoverable by the Ministry under this section the question shall be referred to the Appeal Tribunal and the decision of the Tribunal shall be conclusive for all purposes. (3) A certificate signed by the clerk of the Appeal Tribunal setting forth the decision of the Tribunal upon a question referred to it under this section shall be conclusive evidence of that decision in any legal proceedings; and any certificate purporting to be signed by the clerk of the Appeal Tribunal shall be deemed to be so signed unless the contrary is proved. [(4) Where any amount paid by way of benefit is recoverable under this section, it may, without prejudice to any other method of recovery, be recovered by deduction from benefit under Part II of the Social Security (Northern Ireland) Act 1975]. SUPPLEMENTARY BENEFITS &C. ACT (NORTHERN IRELAND) 1966 - SECT 43 Short title. 43.(1) This Act may be cited as the Supplementary Benefits &c. Act (Northern Ireland) 1966.
