PLANT HEALTH

The Plant Health (Wood and Bark) (Amendment) Order (Northern Ireland) 2002

  Made 16th September 2002 
  Coming into operation 23rd September 2002 

The Department of Agriculture and Rural Development[1] in exercise of the powers conferred on it by sections 2[2], 3(1)[3], 3A[4], 3B(1)[5] and 4(1)[6] of the Plant Health Act (Northern Ireland) 1967[7] and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and comencement
     1. This Order may be cited as the Plant Health (Wood and Bark) (Amendment) Order (Northern Ireland) 2002 and shall come into operation on 23rd September 2002.

Amendment of the Plant Health (Wood and Bark) Order (Northern Ireland) 1993
    
2.  - (1) The Plant Health (Wood and Bark) Order (Northern Ireland) 1993[8] shall be amended in accordance with paragraphs (2) to (6).

    (2) In Article 2(1) -

    (3) In Article 26, for "Directive 77/93/EEC" there shall be substituted "Directive 2000/29/EC".

    (4) In Schedule 2, in Part B (WOOD AND ISOLATED BARK WHICH MAY NOT BE INTRODUCED INTO CERTAIN PROTECTED ZONES AND WHOSE MOVEMENT WITHIN THOSE ZONES IS PROHIBITED IF THEY ARE INFECTED WITH CERTAIN PESTS)

    (5) In Schedule 4 Part B Items 6.2, 6.3 and 7.7 shall be deleted.

    (6) In Schedule 5 Part B, (WOOD, ISOLATED BARK AND USED FORESTRY MACHINERY WHOSE CONSIGNMENT TO A PROTECTED ZONE OUTSIDE NORTHERN IRELAND IS SUBJECT TO SPECIAL CONDITIONS), Items 7, 8, 15 and 16 shall be deleted.

    (7) Schedule 8 (Meaning of "Directive 77/93/EEC" Instruments amending Council Directive 77/93/EEC) shall be deleted.

EXPLANATORY NOTE

(This note is not part of the Order.)


This Order implements certain elements of Commission Directives 2002/29/EC (O.J. No. L77, 20.3.02, p. 26) and 2002/28/EC (O.J. No. L77, 20.3.02, p. 23) also measures required by Council Directives 2001/32/EC and 2001/33/EC both of 8th May 2001 (O.J. No. L127, 9.5.2001, p. 38 and O.J. No. L127, 9.5.2001, p. 42 respectively) by amending the Plant Health (Wood and Bark) Order (Northern Ireland) 1993. Council Directive 2001/32/EC amends the protected zones established under the principal Plant Health Directive, Council Directive 2000/29/EC (O.J. No. L169, 10.7.2000, p. 1) and Council Directive 2001/33/EC provides for consequential amendments to certain Annexes of that Directive.

The Order is amended to remove the protected zone in respect of the pest Pissodes spp. (European) which is present in Great Britain and which has now spread to Northern Ireland and Ireland (Article 2(4)), and to modify the protected zone within England in respect of the pest Dendroctonus micans. (Article 2(5)). Also the amendment removes the protected zone in Corsica in respect of the pest Matsucoccus feytaudi Duc. (Article 2(6)).

Amendments are also made to update the references to the principal Plant Health Directive, Council Directive 2000/29/EC, having replaced the previous Directive, 77/93/EEC (O.J. No. L26, 31.1.77, p. 20) (Articles 2(2), (3) and (6)).

No Regulatory Appraisal has been prepared in respect of this Order.
