The Department of the Environment, being a department designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to the regulation and control of the transit, import and export of waste (including recyclable materials), the prevention, reduction and elimination of pollution caused by waste and the requirement for an assessment of the impact on the environment of projects likely to have significant effects on the environment, in exercise of the powers conferred on it by Articles 30, 48 and 77 of the Waste and Contaminated Land (Northern Ireland) Order 1997[3] and of all other powers enabling it in that behalf, hereby makes the following Regulations:
Citation and commencement

—(1) These Regulations may be cited as the Hazardous Waste (Amendment) Regulations (Northern Ireland) 2005, and shall come into operation on 21 October 2005.
(2) The Interpretation Act (Northern Ireland) 1954[4] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
Amendment of the Hazardous Waste Regulations (Northern Ireland) 2005
2.
—(1) The Hazardous Waste Regulations (Northern Ireland) 2005[5] shall be amended in accordance with paragraphs (2), (3) and (4).
(2) In regulation 43 in paragraph (1) for "under parts 4, 5, 6 and 7" there shall be substituted "under parts 4, 5 and 6 and this Part".
(3) In regulation 45 for "Subject to regulation 43(2) and (3) and 44, a person who commits an offence under this regulation " there shall be substituted "A person who commits an offence under regulation 43".
(4) In regulation 45(a) for "level 5 on the standard scale" there shall be substituted "not exceeding the statutory maximum".

(This note is not part of the Order)
These Regulations amend Regulation 43 (offences) and Regulation 45 (penalties) to refer to the appropriate Regulation, Part and maximum fine in the Hazardous Waste Regulations (Northern Ireland) 2005 (S.R. 2005 No.300).
