The Department of Agriculture and Rural Development, being a Department designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2), hereby makes the following Regulations:
Citation, commencement and interpretation

—(1) These Regulations may be cited as the Pig Carcase (Grading) (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 14th July 2006.
(2) The Interpretation Act (Northern Ireland) 1954[3] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
Amendments to the Pig Carcase (Grading) Regulations (Northern Ireland) 1994

In the Pig Carcase (Grading) Regulations (Northern Ireland) 1994[4] —
(a) in regulation 2(1) —
(i) for the definition of "the Commission Decision" there shall be substituted the following definition —
"the Commission Decision" means Commission Decision 2004/370/EC[5] authorising methods for grading pig carcases in the United Kingdom as amended by Commission Decision 2006/99/EC[6];
(ii) in the definition of "pig carcase", for "Articles 2 and 2a" there shall be substituted "Articles 3 and 4"; and
(b) in regulation 6(b), for "Article 3" there shall be substituted "Article 5".

EXPLANATORY NOTE
(This note is not part of the Regulations.)
These Regulations amend the Pig Carcase (Grading) Regulations (Northern Ireland) 1994 ("the 1994 Regulations"). The 1994 Regulations provide for the administration and enforcement of the Community system of grading pig carcases established by Council Regulation (EEC) No. 3220/84 (O.J. No. L301, 20.11.84 p.1) as amended, the detailed rules for which are set out in Commission Regulation (EEC) No. 2976/85 (O.J. No. L285, 25.10.85, p.39) and Commission Decision 2004/370/EC (O.J. No. L116, 22.4.2004, p.32), as amended.
These Regulations amend the 1994 Regulations so as to take account of Commission Decision 2004/370/EC. This Decision sets out the methods which are authorised for use for grading pig carcases pursuant to Regulation (EEC) No. 3220/84. It authorises two new methods of grading the composition of pig carcases by using the apparatus known as "fully automatic ultrasonic carcase grading" ("AUTOFOM") and the apparatus known as "Hennessy Grading Probe" ("HGP 4"). It withdraws authorisation for use of the apparatus known as "Fat-O-Meater" and it replaces, with minor amendments as to the formulae to be applied to predict lean meat percentages of pig carcases, Commission Decision 88/234/EEC and various amending Decisions.
A Regulatory Impact Assessment has not been prepared for these Regulations because no additional requirements are being imposed.
