FOOD

The Food Hygiene (Amendment) Regulations (Northern Ireland) 2007

  Made 10th January 2007 
  Coming into operation 14th February 2007 

The Department of Health, Social Services and Public Safety[1] makes the following Regulations in exercise of the powers conferred on it by section 2(2) of the European Communities Act 1972[2].

     The Department of Health, Social Services and Public Safety has been designated[3] for the purposes of that section in relation to measures relating to food (including drink) including the primary production of food.

     As required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety[4] there has been open and transparent public consultation during the preparation of the following Regulations.

Citation and commencement
     1. These Regulations may be cited as the Food Hygiene (Amendment) Regulations (Northern Ireland) 2007 and shall come into operation on 14th February 2007.

Amendment to the Food Hygiene Regulations (Northern Ireland) 2006
    
2. —(1) The Food Hygiene Regulations (Northern Ireland) 2006[5] are amended in accordance with paragraphs (2) to (7).

    (2) In paragraph (1) of regulation 2 (interpretation), for the definitions of the Community instruments appearing immediately after the definition of "the Community Regulations" there are substituted the following definitions–

    (3) In regulation 7(9) and regulation 8(2) for "magistrates' court" there shall be substituted "court".

    (4) In regulation 8(10) for the following; "a single arbitrator appointed, failing agreement between the parties by the Head of the Department", there shall be substituted "arbitration[6]".

    (5) In regulation 14(3), for "sworn information" there shall be substituted "sworn complaint".

    (6) Regulation 20 (Appeals to County Court) shall be deleted.

    (7) For Schedule 1 (definitions of Community legislation) there shall be substituted the Schedule set out in the Schedule to these Regulations.
