The Protection of Children and Vulnerable Adults (2003 Order) (Commencement No. 3) Order (Northern Ireland) 2007

  Made 16th July 2007 

The Department of Health, Social Services and Public Safety makes the following Order in exercise of the powers conferred by Article 1(3) of the Protection of Children and Vulnerable Adults (Northern Ireland) Order 2003[1].

Citation
     1. This Order may be cited as the Protection of Children and Vulnerable Adults (2003 Order) (Commencement No.3) Order (Northern Ireland) 2007.

2. The day appointed for the coming into operation of Article 46 of the Protection of Children and Vulnerable Adults (Northern Ireland) Order is 30th July 2007.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order appoints 30th July 2007 for the coming into operation of Article 46, the last remaining provision of the Protection of Children and Vulnerable Adults (Northern Ireland) Order 2003, "the 2003 Order".

Article 46 requires a person who provides care to a vulnerable adult and who proposes to offer an individual employment in a care position to ascertain whether the individual is included in the Disqualification from Working with Vulnerable Adults List kept under Article 35, and if he is included in that list shall not offer him employment in such a position. It also requires that where a person who provides care to a vulnerable adult discovers that an individual employed by him in a care position is included in that list, he shall cease to employ him in a care position.

Article 46 also introduces offences. An individual is guilty of an offence if he knowingly offers work in a care position to, or procures work in care position for, an individual who is included in the Disqualification from Working with Vulnerable Adults List, or fails to remove such an individual from such work. An individual who is included in the Disqualification from Working with Vulnerable Adults List shall also be guilty of an offence if he knowingly applies for, offers to do, accepts or does any work in a care position.
