The Foyle, Carlingford and Irish Lights Commission, with the approval of the North/South Ministerial Council, makes the following Regulations in exercise of the powers conferred by sections 13(1) and 35A of the Foyle Fisheries Act 1952(1) and sections 13(1) and 35A of the Foyle Fisheries Act (Northern Ireland) 1952(2) and now vested in it(3).
1.-(1) These Regulations may be cited as the Foyle Area and Carlingford Area (Prohibition of Unlicensed Fishing) (Prescribed Species) Regulations 2011 and shall come into operation on 1st August 2011.
(2) These Regulations apply in the Foyle Area and the Carlingford Area.
2.-(1) The kinds of fish prescribed for the purposes of section 35A of the Foyle Fisheries Act 1952 and section 35A of the Foyle Fisheries Act (Northern Ireland) 1952 are-
(a)Allis Shad (Alosa alosa);
(b)Arctic Charr (Salvelinus alpinus);
(c)Bream (Abramis brama);
(d)Brown Trout (Salmo trutta morpha fario);
(e)Carp (Cyprinus carpio);
(f)European Eel (Anguilla anguilla);
(g)Golden Grey Mullet (Liza aurata);
(h)Perch (Perca fluviatillis);
(i)Pike (Esox lucius);
(j)Rainbow Trout (Oncorhynchus mykiss);
(k)Roach (Rutilus rutilus);
(l)Rudd (Scardinius erythrophthalmus);
(m)Smelt (Osmerus eperlanus);
(n)Tench (Tinca tinca);
(o)Thin Lipped Grey Mullet (Liza Ramada);
(p)Twaite Shad (Alosa fallax Lacépède).
(2) Any reference in paragraph (1) to a kind of fish includes a hybrid of that kind.
3. The Foyle Area and Carlingford Area (Licensing of Fishing Engines) Regulations 2001(4) are amended in accordance with regulation 4.
4.-(1) In regulation 2 (interpretation) for the definition of "coarse fish" substitute-
""coarse fish" means any kind of fresh water fish that is prescribed for the purposes of section 35A of the Foyle Fisheries Act 1952 and section 35A of the Foyle Fisheries Act (Northern Ireland) 1952, other than brown trout, rainbow trout and pike;".
(2) For regulation 3 (licensing of fishing engines) substitute-
3.-(1) A game fishing rod licence, a coarse fishing rod licence or a fishing licence in respect of any other fishing engine specified in the Schedule may, subject to these Regulations, be issued upon payment to the Commission, in the manner hereinafter prescribed, of the fishing licence fee specified in the Schedule opposite the mention of such licence or fishing engine.
(2) A fishing licence, other than a game fishing rod licence or a coarse fishing rod licence, shall not be issued to any person under the age of eighteen years.".

These Regulations prescribe certain kinds of fish for the purposes of section 35A of the Foyle Fisheries Act 1952 and section 35A of the Foyle Fisheries Act (Northern Ireland) 1952 and make consequential amendments of the Foyle and Carlingford Area (Licensing of Fishing Engines) Regulations 2001.
