The Department of Health, Social Services and Public Safety(1) makes the following Regulations, in exercise of the powers conferred by Article 13 (1) to (4), (6) and (8) of the Social Security (Northern Ireland) Order 1988(2) and section 171 (2) to (5) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(3).
1.-(1) These Regulations may be cited as the Healthy Start Scheme and Day Care Food Scheme (Amendment) Regulations (Northern Ireland) 2011 and shall come into operation on the 6th April 2011.
(2) In these Regulations "the principal Regulations" means the Healthy Start Scheme and Day Care Food Scheme Regulations (Northern Ireland) 2006(4).
(3) The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to an Act of the Assembly.
2.-(1) Schedule 2 (Healthy Start Food) to the principal Regulations is amended as provided by paragraphs (2) and (3).
(2) In the column relating to category of food, after "Fresh" insert "or frozen"; and
(3) In the column relating to qualification, for the existing text substitute -
"Fresh or frozen fruit and vegetables including loose, pre-packed, whole, sliced, chopped, or mixed fruit or vegetables, but not fruit or vegetables to which fat, salt, sugar, flavouring or any other ingredients have been added.".

These Regulations amend the Healthy Start Scheme and Day Care Food Scheme Regulations (Northern Ireland) 2006 ("the principal Regulations").
Regulation 2 amends Schedule 2 to the principal Regulations, by revising the category of fruit and vegetables which can count as Healthy Start food to include frozen as well as fresh fruit and vegetables and by clarifying the qualifications.
