The Department of Health, Social Services and Public Safety(1), in conjunction with the Department of Finance and Personnel, in exercise of the powers conferred by Articles 55A(1)(a), 61(1), (2) and (2AA), 106 and 107(6) of the Health and Personal Social Services (Northern Ireland) Order 1972(2) makes the following Regulations:
In accordance with Article 61(4) of that Order, the Department has consulted with such organisations as appear to be representative of the dental profession.
1. (1) These Regulations may be cited as the General Dental Services (Amendment No. 2) Regulations (Northern Ireland) 2014 and shall come into operation on 12th January 2015.
(2) In these Regulations "the principal Regulations" means the Health and Personal Social Services General Dental Services Regulations (Northern Ireland) 1993(3).
2. (1) The principal Regulations are amended in accordance with paragraphs (2) and (3).–
(2) After regulation 13 (transfer of continuing care and capitation arrangements) insert-
(1) At the termination of a pilot scheme, the Board may, after consultation with the Local Dental Committee and with the agreement of the patients concerned, make arrangements with one or more dentists (whose names are included in the dental list) for the transfer of persons, formerly receiving personal dental services under a pilot scheme, into continuing care arrangements or capitation arrangements.
(2) An arrangement under paragraph (1) may transfer a person to the dentist who had treated that patient while a performer of personal dental services under the pilot scheme.".
(3) In Schedule 2 (terms of service for dentists)–
(a)in paragraph 4(4) (a continuing care arrangement), after "regulation 13" insert "or 13A";
(b)in paragraph 5(3) (a capitation arrangement), after "regulation 13" insert "or 13A".

These Regulations amend the Health and Personal Social Services General Dental Services Regulations (Northern Ireland) 1993 which regulate the terms on which general dental services are provided under the Health and Personal Social Services (Northern Ireland) Order 1972.
Regulation 2 allows for the transfer of patients at the end of a pilot Personal Dental Services scheme into general dental services continuing care arrangements or capitation arrangements. Patient agreement and consultation with the Local Dental Committee is required.
