Historical Institutional Abuse

The Executive Office, in exercise of the powers conferred by section 33(2) of the Historical Institutional Abuse (Northern Ireland) Act 2019(1), makes the following Order.
1.-(1) This Order may be cited as the Historical Institutional Abuse (Northern Ireland) Act 2019 (Commencement No. 2) Order (Northern Ireland) 2020.
(2) In this Order "the Act" means the Historical Institutional Abuse (Northern Ireland) Act 2019.
2. The day appointed for the coming into force of the following provisions of the Act is 2nd November 2020–
(a) Part 2 (The Commissioner for Survivors of Institutional Childhood Abuse); and
(b) Schedule 2 (The Commissioner for Survivors of Institutional Childhood Abuse).

This Order brings into force the remaining provisions of the Historical Institutional Abuse (Northern Ireland) Act 2019.
Part 2 of the Act makes provision for the establishment of the Commissioner for Survivors of Institutional Childhood Abuse and the principal aim of the Commissioner. It also sets out the functions, duties and powers of the Commissioner, provides for the appointment of an Advisory Panel and for an independent review of the operation of the Commissioner.
Schedule 2 to the Act makes further provisions in relation to the operation of the Commissioner with regard to status, general powers, tenure of office, salary, general staffing and other procedural arrangements.
