Found, That a husband has a civil action of damages against one who had committed adultery with his wife, even though there had been no trial or conviction in any criminal court; only the wife was divorced; and on advising the proof found the libel proved, and found it no sufficient defence, that before the defender knew her, she had been debauched by other three men; and found the defender liable in damages and expenses; particularly found him liable in the expense of the process of divorce, and of the appeal in that process, and in the expense of this process; and allowed him to give in his account of damage through loss of business.
