The Scottish Ministers, in exercise of the powers conferred by article 30(1) of the Foot-and-Mouth Disease Order 1983[1] and of all other powers enabling them in that behalf, hereby make the following Order: Citation and commencement 1. - (1) This Order may be cited as the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) Amendment and Revocation Order 2002. (2) For the purposes of article 2, this Order shall come into force at 3.00 p.m. on 11th February 2002 and for all other purposes shall come into force on 18th February 2002. Amendment of the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001 2. In article 4(6) of the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001[2], the words "and, in any case, before that vehicle is moved from those premises" are omitted. Revocations and saving 3. - (1) Subject to paragraph (2) below, the Orders listed in column 1 of the Schedule to this Order are revoked to the extent specified in the corresponding entry in column 3 of that Schedule. (2) Notwithstanding the revocations referred to in paragraph (1) above, the provisions of the Orders listed in the Schedule to this Order shall continue to apply for the purposes of movements authorised thereunder which are commenced but not completed at the coming into force of this article. EXPLANATORY NOTE (This note is not part of the Order) This Order makes an amendment to the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001 ("the Controlled Area Order") with effect from 11th February 2002 to remove the requirement that vehicles moving animals from premises to slaughter be cleansed and disinfected before moving the vehicle from those premises. The Order, with effect from 18th February 2002, revokes all controlled area restrictions remaining in Scotland which were imposed under the Foot-and-Mouth Disease Order 1983 in consequence of foot-and-mouth disease, as set out in Schedule 3. [1] S.I. 1983/1950, as amended by S.I. 1993/3119, S.I. 1995/2922 and, as regards Scotland, by S.S.I. 2001/52, 55, 101 and 390. See article 3(1) for the definition of "the Minister". The functions of "the Minister", so far as exercisable in relation to Scotland, were transferred to the Scottish Ministers by section 53 of the Scotland Act 1998 (c.46).back [2] S.S.I. 2001/111, to which there are no relevant amendments.back
