HIGH COURT OF JUSTICIARY

Act of Adjournal (Criminal Appeals) 2003

  Made 8th August 2003 
  Coming into force 1st September 2003 

The Lord Justice-General, the Lord Justice-Clerk and the Lords Commissions of Justiciary, under and by virtue of the powers conferred upon them by section 305 of the Criminal Procedure (Scotland) Act 1995[1] and of all other powers enabling them in that behalf, do hereby enact and declare:

Citation and commencement
     1.  - (1) This Act of Adjournal may be cited as the Act of Adjournal (Criminal Appeals) 2003 and shall come into force on 1st September 2003.

    (2) This Act of Adjournal shall be inserted in the Books of Adjournal.

Amendment of the Criminal Procedure (Scotland) Act 1995
    
2.  - (1) The Criminal Procedure (Scotland) Act 1995 shall be amended in accordance with the following sub-paragraphs.

    (2) In section 114 (applications made orally or in writing) after the word "Act" there shall be inserted "or to rules made under section 305 of this Act".

    (3) In subsection (1) of section 115 (presentation of appeal in writing) - 

Amendment of the Criminal Procedure Rules
    
3.  - (1) The Criminal Procedure Rules 1996[2] shall be amended in accordance with the following sub-paragraphs.

    (2) In Chapter 15 (appeals from solemn proceedings) - 

    (3) In Chapter 19 (appeals from summary proceedings) - 

    (4) In the appendix, after Form 15.5A-B and Form 19.9 respectively, there shall be inserted the forms set out in the Schedule to this Act of Adjournal.

Transitional and saving
    
4. This Act of Adjournal shall apply to an appeal under sections 106(1)(b) to (e), 108(1), 175(2)(b), (c) or (ca) or by virtue of section 175(4) of the Criminal Procedure (Scotland) Act 1995, in respect of which the Clerk of Justiciary gives intimation on or after 1st September 2003.

    EXPLANATORY NOTE

    (This note is not part of the Act of Adjournal


    This Act of Adjournal makes provision for the lodging of written submissions in appeals against sentence in solemn and summary proceedings.

    Paragraph 2 of the Act of Adjournal amends section 114 (applications made orally or in writing) and section 115 (presentation of appeal in writing) of the Criminal Procedure (Scotland) Act 1995 (1995 c.45) to make those sections subject to any provision in rules of court made under section 305 of that Act.

    Paragraph 3(2) inserts new rule 15.16, and paragraph 3(3) inserts new rule 19.18 into the Criminal Procedure Rules (S.I. 1996/513) to provide for the lodging of written submissions in a specified form in all appeals against sentence in solemn and summary proceedings, respectively.

    The Schedule prescribes the forms inserted into the Appendix to the Criminal Procedure Rules by paragraph 3(4).
