The Scottish Ministers, in exercise of the powers conferred by section 75(3)(a) of the Roads (Scotland) Act 1984[1] and of all other powers enabling them in that behalf, after having given due consideration to the reasonable requirements of navigation in accordance with section 76(1) of the said Act and having complied with the provisions of Part II of Schedule 1 to the said Act[2], hereby make the following Instrument:
Citation, commencement and interpretation
1.
This Instrument may be cited as the Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003 Confirmation Instrument 2004 and shall come into force on 12th March 2004.
2.
In this Instrument "the Scheme" means the Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003.
Confirmation of the scheme
3.
The Scheme is confirmed.
4.
The Scheme as confirmed, the specification of the replacement bridge and the specification of the temporary bridge are set out in the Schedule to this Instrument.

ROADS (SCOTLAND) ACT 1984
THE ANGUS COUNCIL A92 MONTROSE BRIDGE REPLACEMENT BRIDGE SCHEME 2003
Angus Council, in exercise of the powers conferred on them by Section 75(3)(a) of the Roads (Scotland) Act 1984, and all other powers enabling them in that behalf, hereby make the following Scheme:
1.
This Scheme may be cited as the "The Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003".
2.
Angus Council, as roads authority for the area of Angus, is hereby authorised to construct, as part of a public road, a replacement bridge along the line of the existing bridge described in Schedule 1 hereto over the navigable waters of the River South Esk by means of this Scheme, in accordance with Schedule 1 hereto and the road carried by such a replacement bridge shall become a public road on the date the said road is open to traffic.
3.
Angus Council, as roads authority aforesaid, is hereby authorised to construct, as part of a public road, a temporary bridge, upstream of the existing bridge described in Schedule 2 hereto over the navigable waters of the River South Esk by means of this Scheme in accordance with Schedule 2 hereto and the road carried by such a temporary bridge shall become a public road on the date the said road is open to traffic.
SCHEDULE 1 TO THE SCHEME
SPECIFICATION OF REPLACEMENT BRIDGE OVER THE RIVER SOUTH ESK, MONTROSE
Points of Commencement and Termination
The replacement bridge will be constructed on the line of the existing A92 road bridge for a length of 146 metres or thereby from Bridge Street to Rossie Island Road as shown delineated in red on drawing no. 405 entitled "The Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003 Replacement Bridge Location Plan" annexed and executed as relative hereto.
Span
The replacement bridge will consist of 3 spans, a central span of 66 metres, and 2 side spans each of 40 metres shown on drawing no. 841526/03/2/1101/Rev.8 entitled "The Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003" annexed and signed as relative hereto.
Headway
Free headway above the 66 metre wide central span is shown on the said drawing no. 841526/03/2/1101/Rev.8 and will form the existing navigable channel of the River South Esk.
Waterway
The bridge is a perpendicular crossing, navigation channel 66 metres width as shown on the said drawing no. 841526/03/2/1101/Rev.8.
SCHEDULE 2 TO THE SCHEME
SPECIFICATION OF TEMPORARY BRIDGE OVER THE RIVER SOUTH ESK, MONTROSE
Points of Commencement and Termination
The temporary bridge will be located 10m to the west (upstream side) of the existing bridge for a length of 170 metres or thereby from Bridge Street to Esk Road as shown delineated in red on the said drawing no. 406 entitled "The Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003 Temporary Bridge Location Plan".
Public traffic will be diverted on to this bridge in advance of the demolition of the existing 1931 bridge. On completion of the replacement bridge, the public traffic will be transferred to the replacement bridge and the temporary bridge will be taken down.
It is envisaged that the temporary bridge will be in place for 12 months.
Span
The temporary bridge will consist of 14 no. 12 metre spans shown on drawing no. E/E02010/10/Rev.D entitled "The Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003 Temporary Bridge" annexed and signed as relative hereto.
Headway
Free headway above the 12 metre wide spans is shown on the said drawing no. E/E02010/10/Rev.D and will form the temporary navigable channel of the River South Esk.
Waterway
The bridge is a perpendicular crossing, navigation channel 12 metres width as shown on the said drawing no. E/E02010/10/Rev.D.

EXPLANATORY NOTE
(This note is not part of the Instrument)
This Instrument confirms the Angus Council A92 Montrose Bridge Replacement Bridge Scheme 2003. Copies of the Scheme and the accompanying plans have been deposited and may be inspected during business hours at the Planning Department Reception, Angus Council, St. James House, St. James Road, Forfar and at Montrose Library, 216 High Street, Montrose.
