The Scottish Ministers, in exercise of the powers conferred on them by section 30(1) of the Ethical Standards in Public Life etc. (Scotland) Act 2000[1] and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 30(3) of that Act, been laid before and approved by resolution of the Scottish Parliament:
Citation and commencement
1.
This Order may be cited as the Ethical Standards in Public Life etc. (Scotland) Act 2000 (Modification of National Parks (Scotland) Act 2000) Order 2004, and shall come into force on the day after the day on which it is made.
Modification of the National Parks (Scotland) Act 2000
2.
Paragraph 18 of schedule 1 to the National Parks (Scotland) Act 2000[2] (members' interests) shall cease to have effect in relation to members of the Loch Lomond and The Trossachs National Park Authority[3] and of the Cairngorms National Park Authority[4].

EXPLANATORY NOTE
(This note is not part of the Order)
This Order modifies the National Parks (Scotland) Act 2000 by disapplying the provisions of paragraph 18 of schedule 1 to that Act (members' interests) in relation to members of the Loch Lomond and The Trossachs National Park Authority and of the Cairngorms National Park Authority.
Those National Park authorities are included in the list of devolved public bodies contained in schedule 3 to the Ethical Standards in Public Life etc. (Scotland) Act 2000 ("the 2000 Act").
The 2000 Act requires members of a devolved public body to prepare a Code of Conduct based on the model code prepared under the 2000 Act.
The National Parks (Scotland) Act 2000 is modified to remove the specific requirements of paragraph 18 of Schedule 1 in relation to members' interests. The appropriate provisions of the Code of Conduct will apply in their place.
