MENTAL HEALTH

The Mental Health (Class of Nurse) (Scotland) Revocation Order 2005

  Made 12th September 2005 
  Coming into force in accordance with article 1

The Scottish Ministers, in exercise of the powers conferred by section 25(2) and (6) of the Mental Health (Scotland) Act 1984[1] and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement
     1. This Order may be cited as the Mental Health (Class of Nurse) (Scotland) Revocation Order 2005 and shall come into force immediately before 5th October 2005.

Revocation of Order
    
2. The Mental Health (Class of Nurse) (Scotland) Order 1994[2] is revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)


This Order revokes the Mental Health (Class of Nurse) (Scotland) Order 1994 immediately before 5th October 2005.

This avoids this Order being deemed to have effect on and after 5 October 2005 as if made under section 299 of the Mental Health (Care and Treatment) (Scotland) Act 2003 (asp 13) by virtue of section 299(9) of that Act.

[1] 1984 c.36 ("the 1984 Act"). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46). Section 25(6) of the 1984 Act contains a definition of "prescribed".back
