COURT OF SESSION

Act of Sederunt (Rules of the Court of Session Amendment) (Miscellaneous) 2006

  Coming into force 17th March 2006 

The Lords of Council and Session, under and by virtue of the powers conferred upon them by section 5 of the Court of Session Act 1988[1] and of all other powers enabling them in that behalf, do hereby enact and declare:

Citation and commencement
     1. —(1) This Act of Sederunt may be cited as the Act of Sederunt (Rules of the Court of Session Amendment) (Miscellaneous) 2006 and shall come into force on 17th March 2006.

    (2) This Act of Sederunt shall be inserted in the Books of Sederunt.

Amendment of the Rules of the Court of Session
    
2. —(1) The Rules of the Court of Session 1994[2] shall be amended in accordance with the following sub-paragraphs.

    (2) In rule 41.3 (determination of applications for leave to appeal)–

    (3) After rule 41.3A (competency of appeal)[3] there shall be inserted–

    (4) In Chapter 43 (personal injuries actions)[4] for rule 43.11(3) (applications for interim damages) there shall be substituted the following:–

    (5) Paragraph (1)(m) of rule 49.8 (warrants for intimation in family actions) as inserted by the Act of Sederunt (Rules of the Court of Session Amendment No. 9) (Civil Partnership Act 2004 etc.) 2005[5] shall be numbered paragraph (1)(n) of that rule.

    (6) In Part II of Chapter 63 (applications relating to trusts: petitions for directions)–

    (7) In Part IIA of Chapter 70 (international child abduction: applications under the Hague Convention where the Council Regulation applies) in rule 70.19 (recording of hearings under Article 12 of the Hague Convention)[6]–

    (8) In Part I of Chapter 74 (companies: general provisions)–

    (9) In Part III of Chapter 74 (companies: administration procedure)[10]–

    (10) At the end of Part V of Chapter 74 (companies: winding up of companies) there shall be inserted the following:–

    (11) For rule 82.3(1) (declaration of incompatibility)[17] there shall be substituted the following:–

    (12) In rule 88.1 (interpretation of Chapter 88: civil matters involving parental responsibilities under the Council Regulation)[18]–

    (13) For rule 88.2 (transfers of cases involving matters of parental responsibility) there shall be substituted–

    (14) In rule 88.3 (transfers where proceedings ongoing in the sheriff court)–

    (15) In rule 88.5(5) (acceptance of jurisdiction) for "requesting court" there shall be substituted "foreign court".

    (16) In rule 88.6 (request to decline jurisdiction from a court in another Member State)–

    (17) After rule 88.6 there shall be inserted–

EXPLANATORY NOTE

(This note is not part of the Act of Sederunt)


This Act of Sederunt makes miscellaneous amendments to the Rules of the Court of Session 1994 (S.I. 1994/1443) (‘the Rules').

Paragraph 2(2) and (3) makes minor amendments to the rules relating to appeals under statute.

Paragraph 2(4) amends the Rules as to the apportionment of interim damages in personal injuries actions.

Paragraph 2(5) makes a minor amendment to the Rules relating to proceedings under the Civil Partnerships Act 2004.

Paragraph 2(6) makes provision in respect of certain applications by executors of deceased underwriting members of Lloyd's of London.

Paragraph 2(7) makes minor amendments to the rules relating to proceedings under the Hague Convention.

Paragraph 2(8) and (9) makes provision consequential upon the Energy Act 2004 and the Energy Administration (Scotland) Rules 2006.

Paragraph 2(10) makes provision for the appointment of a replacement liquidator in more than one petition for the winding up of a company.

Paragraph 2(11) amends the Rules relating to declarations of incompatibility under the Human Rights Act 1998.

Paragraph 2(12)–(17) makes various minor amendments to the Rules relating to the Council Regulation (E.C.) No. 2201/2003 of 27th November 2003 on jurisdiction and the recognition and enforcement of judgments in matrimonial matters and matters of parental responsibility.

Paragraph 2(18) makes various minor and consequential amendments to the forms set out in the Appendix to the Rules.
