The Scottish Ministers make the following Regulations in exercise of the powers conferred on them by section 33 of the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 2003[1] and of all other powers enabling them to do so.
The Regulations are made on application to the Scottish Ministers by the River Ness district salmon fishery board.
In accordance with paragraphs 10, 11 and 14 of schedule 1 to that Act as applied by section 33(7) of that Act they have carried out all necessary consultations, complied with all necessary procedures and considered all objections duly made.
Citation and commencement
1.
These Regulations may be cited as the River Ness Salmon Fishery District (Baits and Lures) Regulations 2007 and shall come into force on 17th October 2007.
Specification of prohibited baits and lures and areas of application

There is specified as prohibited for the purposes of the definition of "rod and line" in section 4(1) of the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 2003–
(a) in relation to the River Ness salmon fishery district, natural prawns and shrimps (whether fresh or preserved, dyed or natural colour) and any part thereof; and
(b) in relation to that part of the River Ness salmon fishery district above Dochfour Weir, any worm artificial or natural (whether fresh or preserved) and any part thereof.
Revocation
3.
The River Ness Salmon Fishery District (Baits and Lures) Regulations 1990[2] are revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations specify natural prawns and shrimps (and any part of them) and natural (fresh or preserved) or artificial worms (and any part of them) for the purposes of the definition of “rod and line in section 4(1) of the Salmon and Freshwater Fisheries (Consolidation) (Scotland) Act 2003. The effect of this is to prohibit the use of such prawns and shrimps and worms (or any part of them) as bait when fishing by rod and line for salmon and sea trout. The ban on prawns and shrimps applies throughout the River Ness salmon fishery district and the ban on worms applies in the part of that salmon fishery district above Dochfour Weir. In both cases the ban applies without any time limit (regulation 2).
The River Ness Salmon Fishery District (Baits and Lures) Regulations 1990 are revoked having been replaced by these Regulations (regulation 3).
A Regulatory Impact Assessment in relation to these Regulations has been prepared and placed in the Scottish Parliament Information Centre. Copies of it can be obtained from the Scottish Executive Environment and Rural Affairs Department, Pentland House, 57 Robb's Loan, Edinburgh EH14 1TY.
