ENVIRONMENTAL PROTECTION

The Water Environment and Water Services (Scotland) Act 2003 (Commencement No. 7) Order 2007

  Made 28th November 2007 

The Scottish Ministers make the following Order in exercise of the powers conferred by section 38(1) of the Water Environment and Water Services (Scotland) Act 2003[1].

Citation
     1. This Order may be cited as the Water Environment and Water Services (Scotland) Act 2003 (Commencement No. 7) Order 2007.

Appointed Day
    
2. 14th December 2007 is the appointed day on which the following provisions of the Water Environment and Water Services (Scotland) Act 2003 come into force:–

EXPLANATORY NOTE

(This note is not part of the Order)


This Order brings into force further provisions of the Water Environment and Water Services (Scotland) Act 2003 ("the Act") on 14th December 2007, which provide as follows:–

    • Section 12 concerns the submission of a river basin management plan by the Scottish Environment Protection Agency to the Scottish Ministers;

    • Section 13 concerns the approval process in relation to the river basin management plan;

    • Section 14 concerns the review of river basin management plans;

    • Section 16 concerns the duty of the Scottish Ministers and public bodies to have regard to river basin management plans and sub-basin plans; and

    • Section 19 contains general regulation making powers of the Scottish Ministers in relation to river basin management plans.

The Act received Royal Assent on 5th March 2003.
