The Housing (Scotland) Act 2006 (Penalty Charge) Regulations 2007

The Scottish Ministers make the following Regulations in exercise of the powers conferred by paragraph 2 of schedule 3 to the Housing (Scotland) Act 2006(1) and all other powers enabling them to do so.

Citation and commencement

1. These Regulations may be cited as the Housing (Scotland) Act 2006 (Penalty Charge) Regulations 2007 and come into force on 1st October 2008.

Amount of penalty charge

2. The amount of penalty charge prescribed for the purposes of paragraph 2 of schedule 3 to the Housing (Scotland) Act 2006 is £500.

Explanatory Note

(This note is not part of the Regulations)

These Regulations prescribe a penalty charge of £500 which is to be specified in notices issued under section 111 of the Housing (Scotland) Act 2006. Such a notice may be issued where there has been a breach of the duties under sections 98, 99(1), 101(2) or 103(2) of the Act to possess, and make available copies of certain prescribed documents when a house is to be put on the market for sale.

The documents may be prescribed under section 104 of the Act.
