The Police Pensions (Contributions) Amendment (Scotland) Regulations 2013

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 1 of the Police Pensions Act 1976(1) and all other powers enabling them to do so.

In accordance with section 1(1) of that Act they have consulted with the Police Negotiating Board for the United Kingdom(2).

Citation, commencement, and extent

1.-(1) These Regulations may be cited as the Police Pensions (Contributions) Amendment (Scotland) Regulations 2013.

(2) These Regulations come into force on 1st April 2013.

(3) These Regulations extend to Scotland only.

Amendment of the Police Pensions Regulations 1987

2.-(1) Regulation G2 (pension contributions payable by regular policeman) of the Police Pensions Regulations 1987(3) is amended as follows.

(2) In paragraph (1)-

(a)omit "and regulation G2A";

(b)for "police officer", substitute "policeman";

(c)in sub-paragraph (a), for "8.1" substitute "8.7"; and

(d)in sub-paragraph (b), for "11.6" substitute "12.2".

(3) In paragraph (2)-

(a)omit "and regulation G2A";

(b)in sub-paragraph (a), for "8.75" substitute "10"; and

(c)in sub-paragraph (b), for "12.25" substitute "13.5".

(4) In paragraph (3)-

(a)omit "and regulation G2A";

(b)in sub-paragraph (a), for "9" substitute "10.5"; and

(c)in sub-paragraph (b), for "12.5" substitute "14".

Amendment of the Police Pensions (Scotland) Regulations 2007

3.-(1) Regulation 7 (pension contributions payable by regular police officers) of the Police Pensions (Scotland) Regulations 2007(4) is amended as follows.

(2) In paragraph (1)-

(a)omit "and regulation 7A";

(b)in sub-paragraph (a), for "6.6" substitute "7.2"; and

(c)in sub-paragraph (b), for "10.1" substitute "10.7".

(3) In paragraph (2)-

(a)omit "and regulation 7A";

(b)in sub-paragraph (a), for "7" substitute "8"; and

(c)in sub-paragraph (b), for "10.5" substitute "11.5".

(4) In paragraph (3)-

(a)omit "and regulation 7A";

(b)in sub-paragraph (a), for "7.25" substitute "8.5"; and

(c)in sub-paragraph (b), for "10.75" substitute "12".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police Pensions Regulations 1987 (as regards Scotland) and the Police Pensions (Scotland) Regulations 2007 to adjust the pension contributions of police officers as from 1st April 2013. These Regulations also amend both the 1987 and 2007 Regulations to correct errors contained in the Police Pensions (Contributions) Amendment (Scotland) Regulations 2012 (S.S.I. 2012/71).

1976 c.35 ("the 1976 Act"). Section 1 was amended by section 2(3) of the Police Negotiating Board Act 1980 (c.10), section 103 and paragraph 28 of Schedule 7 to the Police Act 1996 (c.16) and section 1(1) of the Police and Firemen's Pensions Act 1997 (c.52). These powers were extended by section 42 of the Welfare Reform and Pensions Act 1999 (c.30). The functions of the Secretary of State as regards Scotland were transferred to the Scottish Ministers by the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999 (S.I. 1999/1750), article 2 and Schedule 1. The requirement for consent by the Minister for the Civil Service under section 1 was transferred to the Treasury by virtue of S.I. 1981/1670, and such consent is not required in the exercise by the Scottish Ministers of the transferred functions by virtue of S.I. 1999/1750 and section 63 of the Scotland Act 1998 (c.46).
