The Scottish Ministers make the following Order in exercise of the powers conferred by section 7(3) of the Pollution Prevention and Control Act 1999(1) and all other powers enabling them to do so.

Citation and commencement

1.-(1) This Order may be cited as the Pollution Prevention and Control Act 1999 (Commencement No. 4 and Amendment) (Scotland) Order 2015.

(2) This article and article 2 come into force on 31st March 2015.

(3) Article 3 comes into force on 1st April 2015.

Amendment to the Pollution Prevention and Control Act 1999 (Commencement No. 3) (Scotland) Order 2015

2.-(1) The Pollution Prevention and Control Act 1999 (Commencement No. 3) (Scotland) Order 2015(2) is amended as follows.

(2) In article 2(2), omit sub-paragraphs (h) to (l).

Appointed day

3.  1st April 2015 is the day appointed for the coming into force of section 6(2) of, and Schedule 3 to, the Pollution Prevention and Control Act 1999 so far as relating to the following repeals in the Environment Act 1995(3)-

(a)section 111(6);

(b)section 113(5), in the definition of "local enforcing authority", paragraph (d) and the "or" preceding it;

(c)in section 114(2)(a)(iii), "15, 22(5),";

(d)in paragraph 4(3)(b) of Schedule 20, "22(5),"; and

(e)paragraphs 45 to 61 of Schedule 22.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order corrects an error in the Pollution Prevention and Control Act 1999 (Commencement No. 3) (Scotland) Order 2015 before that Order comes into force. Article 3 ensures that certain repeals to the Environment Act 1995 made by Schedule 3 to the Pollution Prevention and Control Act 1999 are clearly commenced on 1st April 2015.
