The Scottish Ministers make the following Order in exercise of the powers conferred by section 107(1) and (2) of the Courts Reform (Scotland) Act 2014(1) and all other powers enabling them to do so.
1. This Order may be cited as the Sheriff Court Fees Amendment Order 2018 and comes into force on 28th September 2018.
2.-(1) The Sheriff Court Fees Order 2018(2) is amended as follows.
(2) Omit article 5(2) (matters included in certain fees).
(3) After article 9 (exemption of certain persons from fees: social security) insert-
9A. Articles 8 and 9 do not apply as regards-
(a)the fees specified in paragraphs 1 to 4 (commissary proceedings) of the Table of Fees in Part 1 of schedule 1, 2 or 3; or
(b)the fee specified in paragraph 18 (sheriff court proceedings: petition for removal of disqualification) of the Table of Fees in Part 1 of schedule 1, 2 or 3.".

This Order amends the Sheriff Court Fees Order 2018 which makes provision for the fees payable in the sheriff court, to the sheriff clerk or the auditor of court (as appropriate).
Article 2(2) revokes a redundant provision of that Order.
Article 2(3) provides that the fees exemptions in articles 8 and 9 of that Order (concerned with legal aid and social security respectively) do not apply in certain cases, as was previously provided for by article 8(2) of the Sheriff Court Fees Order 2015 (S.S.I. 2015/264).
