DECISION AND REASONS

1.              On 8 September I wrote to the parties as follows:

"I have reviewed the papers. In the light of the Joint Minute I propose without more ado to reach a decision that the First-tier Tribunal erred in law for the reasons there set out; to set aside its decision; and to remit the appeal to the First-tier Tribunal for a fresh hearing.

Any proposals to the contrary will be considered if received before 17 October 2022"

2.              No response has been received.

3.              I find that the decision of the First-tier Tribunal involved the making of an error of law. I set it aside. I remit the appeal to the First-tier Tribunal for a fresh hearing.
