PRELIMINARY HEARING

MR JUSTICE MORISON (PRESIDENT): In my view and that of my colleagues, there is just an arguable point in this case. There are two issues. The first is the status of a supply teacher in general terms and the second is whether, if a supply teacher is not an employee, in the circumstances of this case can he become an employee as a result of the employment history which he enjoyed.
Those two issues will require consideration and we would hope that the Respondent, Essex County Council, in particular will deal with the first point, which is a matter of some importance. We estimate that this case will take half a day in total. It should be listed as Category B.
There are no further directions to be given at this time other than the Council should serve their Notice in due time.
