    JUDGE LEVY: Mr Linden appears before us this morning for the Appellant in this case. He has produced an amended Notice of Appeal taking at its forefront an alleged misdirection in the decision of the Employment Tribunal by reference to the case in McMeechan v Secretary of State for Employment [1997] ICR 549 CA.

  1. He seeks to amend the Notice of Appeal so that that point should become the first point in the appeal with later modification to the Notice.
  2. Subject to the right of the Respondent to object at the hearing to the amendment, we give leave for an amended Notice of Appeal to be served in that form and will allow the appeal to go forward. We are persuaded that there is an arguable case, estimated length half a day, Category C.
