  1. In this Ex Parte Preliminary Hearing of an appeal by Stanley Cole (Wainfleet) Ltd, the Respondent below, we have had the benefit this morning of hearing from Dr Cohen, a director of the company who appeared below. He has satisfied us that the points made in his skeleton argument show grounds for the case to go to a full hearing on the grounds in the notice of appeal are arguable.
  2. We have told him that he may not be successful at the full hearing and that he may be at risk as to costs if he fails on some or all of the grounds but it seems to us that there are grounds for this matter to go forward to a full hearing. Category C. Time Estimate - 1 day.
