Decision notes [2019] UKFTT 14 (PC). Applicant claimed under a resulting or constructive trust against his former partner, who had purchased the property under the right-to-buy scheme. Shortly before the hearing the applicant’s general practitioner sent a report saying that the applicant was suffering from depression. The Tribunal did not consider that this was sufficient to show that the applicant could not appear at the hearing and participate in it. The applicant renewed his application without any further medical evidence. An adjournment was refused. The applicant failed to attend the hearing. In the absence of his evidence, the case failed.
