Summary: The complainant requested information from Department of Trade and Industry (DTI), now the Department for Business, Innovation and Skills (BIS), relating to its consideration of the legal position of the group Women Empowering Women. The Commissioner finds that the DTI (now BIS) was correct to withhold the information under section 42 of the Act as the withheld information is information in respect of which a claim to legal professional privilege could be maintained in legal proceedings and, in all the circumstances of the case, the public interest in maintaining the exemption to disclosure provided by section 42 outweighs the public interest in disclosing the information. Information Tribunal appeal number EA/2009/0070 has been dismissed.
