Summary: The complainant requested a copy of an agreement between the public authority and the UK government regarding the authority-™s modernisation plans. Parts of the agreement were disclosed and the remainder withheld by virtue of the exemptions at sections 43(2) (commercial interests) and 36(2)(c) (prejudice to effective conduct of public affairs) of the Act. During the Commissioner-™s investigation, the public authority disclosed some information from the agreement but maintained its reliance on the above exemptions in respect of the remaining information. After considering the agreement, the Commissioner finds that some information was correctly withheld under sections 43(2) and 36(2)(c). However, he finds that in respect of the remainder of the withheld information, either the information was not exempt or the balance of the public interest was in favour of disclosure. Details of the Commissioner-™s decision can be found in Annex B to the Notice. Information Tribunal appeal number EA/2010/0091 withdrawn.
