Summary: The complainant made two requests to the Police Service of Northern Ireland (PSNI) for information relating to travel arrangements made by or on behalf of the son of the then Chief Constable. The PSNI refused to confirm or deny whether it held the requested information, citing the exemption at section 40(5) (third party personal data). The Commissioner considers that section 40(5) has been incorrectly applied in this instance and the PSNI is required to confirm or deny whether it holds information relating to the first request and to consider the second request accordingly.
