Summary: On 18 February 2010 the complainant requested that her doctor-™s practice should provide her with a copy of the second component of its application for -˜paper light-™ status (regarding the keeping and transferring of electronic NHS records). For the purposes of the Act the individual doctors within the practice are considered to be the public authorities. This Notice is therefore addressed to the senior partner in the practice, as the relevant public authority. This was the latest request in a series of requests and correspondence which had started in 2000 and was concerned with the information held on the complainant-™s medical records and the right of the practice to keep electronic records. This current request has been refused as vexatious under section 14(1) of the Act. The Commissioner is satisfied that the public authority was correct to refuse the request; however the Commissioner has found several procedural breaches. Information Tribunal appeal number EA/2010/0194 dismissed.
