Summary: The complainant requested detailed information about payments made by the council to Liverpool Direct Limited. The council provided some of the information, refusing the remaining information on the basis that it was not held. During the Commissioner-™s investigation the council confirmed that it did hold the remaining information requested and refused to disclose it, applying the exemption contained at section 43(2) of the Freedom of Information Act. The Commissioner has considered the application of section 43(2) and has upheld the council-™s decision to withhold the information; he does not require the council to take any further action.
