Summary: The complainant requested information relating to the Church Village Bypass. The Council provided some information relevant to the request but in relation to one piece of information, it initially agreed to provide the information, and subsequently stated that the information was not held. The Commissioner considers that the information requested, if held, would be environmental information and should have been considered under the EIR. The Commissioner requires the Council to reconsider the request under the EIR and either disclose the information requested or issue a valid refusal notice in accordance with regulation 14 of the EIR.
