Summary: The complainant requested information in respect of the employment history of two named social workers. The Council refused to provide this information citing section 40(2) of the Act. The Commissioner has investigated and finds that the Council correctly applied section 40(2) of the Act. The Commissioner has also recorded a breach of section 17(1)(c) of the Act in respect of the Council-™s handling of this request for information.
