Summary: The complainant requested the Council to release all documents that were submitted to the Budgetary Challenge Panels in October 2010 for the setting of the council-™s budget for 2011 and 2012. The Council responded to this request refusing to release this information under sections 36(2)(b)(i) and (ii) and 36(2)(c) of the Act. The Commissioner-™s decision is that Council correctly relied on section 36(2)(b)(i) and (ii) of the Act for the non disclosure of the requested information. As the Council complied with the provisions of the Act in this case he requires no further action to be taken. Information Tribunal appeal EA/2011/0253 withdrawn.
