Summary: The complainant requested the full medical reasons for moving overcrowded households from band 3 to band 2 from Southwark Council (the council) during a specified period of time. The council withheld the information under section 12 of the FOIA. The Commissioner-™s decision is that the council has correctly applied section 12. He requires no steps to be taken in this case. However, the Commissioner finds that the public authority failed to comply with section 17(5) of the FOIA in that it did not cite section 12(1) within 20 working days of receipt of the request.
