Summary: The complainant has requested information relating to a decision to decline to carry out an Environmental Impact Assessment (EIA) direction. The Department for Communities and Local Government (DCLG) provided some information within the scope of the request but withheld the remainder of the information relying on regulation 12(5)(b) of the EIR as it considered that the information was subject to a claim of legal professional privilege (LPP). The Commissioner-™s decision is that DCLG has correctly withheld the remainder of the information under regulation 12(5)(b) of the EIR. The Commissioner does not require any steps to be taken.
