Summary: The complainant has requested information from the Marlborough Medical Practice (the -Practice-) concerning the Practice and its expenditure for 2009-2011. The Practice provided some information and initially applied section 43(2) of the FOIA to the withheld information. During the course of the investigation it explained that it does not hold total GP pay, dispensary income and profit figures for the purposes of the FOIA as it cannot separate the NHS information requested from the combined NHS and private information which it holds. It has also argued that it does not hold any information in relation to one of the requests (question 9). The Commissioner-s decision is that the Practice does hold total GP pay, dispensary income and profit figures for the purposes of the FOIA. However he considers this information to be exempt under section 43(2) of the FOIA. The Commissioner is also satisfied that the Practice does not hold any information in relation to question (9). He does not require any steps to be taken.
