Summary: The complainant has requested information regarding complaints about the victimisation of safety representatives. The Commissioner-™s decision is that on the balance of probabilities the Health and Safety Executive (HSE) does not hold the requested information for requests 1 and 2. The Commissioner has also found that information relevant to requests 3 and 4 is held. HSE should have either provided this information or applied the exemption under section 21 of the Freedom of Information Act 2000 (the Act) as the basis for its refusal. However no further action is required.
