Summary: The complainant has requested information relating to how the Department for Communities and Local Government (-˜DCLG-™) responded to an earlier request for information. The Commissioner-™s decision is that DCLG correctly engaged the exemptions at sections 36(2)(b)(i) and 36(2)(b)(ii) but in all the circumstances of the case, the public interest in disclosure outweighs the public interest in maintaining the exemption. The Commissioner requires the public authority to disclose the information withheld under sections 36(2)(b)(i) and 36(2)(b)(ii) to ensure compliance with the legislation.
