Summary: The complainant requested copies of two particular -˜Notice of Immigration-™ decisions for two applicants who had applied via the Home Office-™s -˜Tier 4 (General) Student-™ system for immigration. The Home Office refused to disclose the requested information on the basis of section 40(2) of FOIA. The Commissioner is satisfied that section 40(2) has been relied on correctly but by failing to issue its refusal notice within 20 working days of the request Home Office breached section 17(1) of FOIA.
