The complainant has requested from London Borough of Hounslow (“the Council”) a copy of a Building Regulations application in respect of a specific property. The Commissioner’s decision is that the Council has failed to either provide the requested information or issue a valid refusal notice within the 20 working day statutory time limit as set out in regulation 5(2) of the EIR. The Commissioner requires the Council to issue a response under the EIR. The Council must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Freedom of Information Act 2000 and may be dealt with as a contempt of court.
